Could somebody explain to me how Bill O'Reilly is not being sued for defamation?

Lawrence Lessig :: Mr. O’Reilly, please just stop. O'Reilly is worse than "yellow journalism"; the man is a hateful pathological slanderer. I still have to ask, why is this man not liable for a lawsuit? Or is this a pre-emptive request that, if ignored, could be used against him?
